Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and WordGate (“WordGate,” “we,” “our,” or “us”) covering your use of the WordGate mobile application (bundle ID com.bartua.WordGate, the “App”) on iOS and Android. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
WordGate does not use user accounts. In these Terms, “your account” means your local installation of the App on a device you control, together with any in-app purchases made through your Apple ID or Google account.
1. Eligibility
- You must be at least 13 years old, or the minimum age of digital consent in your country (for example, 16 in parts of the European Economic Area).
- If you are under the age of majority where you live (typically 18), you may only use the App with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.
- You must also accept and comply with the terms of the app store through which you obtained the App — the Apple App Store or Google Play. Those terms apply in addition to these Terms.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on devices that you own or control, solely for your own personal, non-commercial use, and subject to these Terms and the rules of your app store.
You agree not to:
- copy, modify, translate, or create derivative works of the App, except as expressly allowed by law;
- reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law;
- extract, scrape, or redistribute the vocabulary, translations, lessons, or other content delivered through the App;
- rent, lease, lend, sell, sublicense, or otherwise transfer the App or your license to use it; or
- remove or alter any proprietary notices, labels, or branding on the App.
If you jailbreak, root, or otherwise modify your device, or use the App through unofficial clients or modifications, we may suspend your access and we are not responsible for the resulting behavior of the App, including any failure of the lock feature described in Section 5.
3. Subscriptions and In-App Purchases
The App is free to download. It offers an optional paid subscription, WordGate Pro. All purchases are made through the Apple App Store or Google Play — we do not process payments or store payment card details ourselves.
3.1 Plans
- Free: one vocabulary word per day and one emergency bypass per week.
- WordGate Pro: configurable daily word goals, three emergency bypasses per week, and additional proficiency levels.
Feature lists and limits are described in the App and may be updated from time to time. The then-current description of each plan at the point of purchase governs what is included.
3.2 Auto-renewal (please read carefully)
- Payment. When you subscribe, payment is charged to your Apple ID or Google account at confirmation of purchase.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period (for example, monthly or yearly) at the then-current price for the selected plan, unless you cancel at least 24 hours before the end of the current period.
- Cancellation. You can cancel any time by managing subscriptions in your Apple ID settings (iOS: Settings › [your name] › Subscriptions) or your Google Play account (Android: Play Store › Payments & subscriptions › Subscriptions). Cancelling stops future renewals; it does not refund the current period, and you keep Pro access until the current period ends.
- Free trials and introductory offers. If a free trial or introductory offer is provided, any unused portion of the trial is forfeited if you subscribe during the trial. The trial automatically converts to a paid subscription at the standard price unless you cancel at least 24 hours before it ends.
3.3 Pricing and price changes
- Current prices are shown in the App at the point of purchase and may vary by region, currency, local taxes, and promotion.
- If we change the price of an existing subscription, we will provide at least 30 days' notice before the change takes effect, through an in-app notice or, where we have it, by email. If you do not accept the new price, you can cancel before the next renewal.
3.4 Refunds
Because purchases are made through Apple or Google, refunds are handled according to their policies. We are not able to issue refunds directly. To request a refund:
- Apple: visit https://reportaproblem.apple.com.
- Google Play: visit https://support.google.com/googleplay/answer/2479637.
Statutory rights that cannot be waived under the law of your place of residence (including, for consumers in the EU/UK, the right of withdrawal where applicable) are not affected by this section.
4. Your Conduct
When using the App, you agree not to:
- configure the App to block or restrict apps on a device you do not own or for which you do not have permission from the owner and user;
- attempt to defeat, tamper with, or otherwise exploit the lock mechanism beyond the bypass options provided in the App;
- use bots, scripts, or other automation to complete lessons, quizzes, or bypasses; or
- use the App for any unlawful or harmful purpose.
5. How the Lock Works — Important Disclaimers
WordGate is a self-imposed lock. On iOS, it uses Apple's Family Controls / Screen Time APIs to restrict apps you select on your own device; it is not a parental control over someone else. On Android, it uses the accessibility and overlay APIs to restrict apps you select on your own device.
- The effectiveness of the lock depends on the behavior of the operating system and on permissions you grant. We do not control how iOS or Android enforce these APIs, and behavior may change between OS versions.
- The lock can be defeated — including by uninstalling the App, revoking permissions, switching device profiles, or resetting the device. We do not attempt to prevent this, and we are not responsible for the consequences of you (or anyone with access to your device) circumventing your own lock.
- Emergency services, phone calls, and core system functions remain available regardless of what you have blocked.
- Vocabulary content, translations, example sentences, and pronunciations are provided on an “as is” basis. We work to make them accurate, but they may not be correct for every dialect, register, or context, and should not be relied on for professional, medical, legal, or safety-critical use.
- The daily word schedule and notifications are approximate and depend on your device's OS, battery, and connectivity. We do not guarantee exact timing of notifications.
- We make no promise of any specific outcome — including productivity, focus, reduced phone use, or language fluency. Your results depend on your own effort and use of the App.
The App works offline after the initial content sync; some features (for example, updating your plan or receiving new content) require an internet connection.
6. Disclaimer of Warranties
To the fullest extent permitted by law, the App and all content in it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that it will meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
7. Limitation of Liability
To the fullest extent permitted by law, WordGate and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the App — including, without limitation, missed notifications, missed meetings or appointments, time spent on lessons, or the lock blocking or failing to block any app.
Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the App will not exceed the greater of (a) the total amount you paid to us through in-app purchases in the twelve (12) months immediately preceding the event giving rise to the claim and (b) US $20.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
8. Indemnification
You agree to defend, indemnify, and hold harmless WordGate from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App, your breach of these Terms, or your violation of any law or the rights of a third party.
9. Termination
These Terms apply while you use the App. We may suspend or terminate your access to the App at any time if you materially breach these Terms, if required by law, or if we stop offering the App. You may stop using the App at any time by:
- uninstalling the App from your device; and
- cancelling any active subscription through your Apple ID or Google Play account (see Section 3.2).
Uninstalling the App removes locally stored data. Server-side analytics records associated with your device identifier can be deleted on request (see Section 13). Uninstalling does not cancel a subscription; you must cancel through the store.
Sections 2 (last paragraph), 6, 7, 8, 11, 12, and 13, and any payment obligations accrued before termination, survive termination.
10. Changes to the App and to These Terms
We may add, change, or remove features of the App at any time. For material changes to these Terms, we will provide at least 30 days' notice through an in-app notice or, where we have it, by email, and we will update the “Last updated” date above. Material changes that are unfavorable to you will not apply retroactively. Your continued use of the App after changes take effect means you accept the updated Terms. If you do not accept them, stop using the App and cancel any subscription before the effective date.
11. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the developer of WordGate is established, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally will be brought in the courts of that jurisdiction, and you and we each submit to their exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of the country in which you live. If you are a consumer in the EU or UK, you may also bring proceedings in the courts of your country of residence.
12. Apple App Store — Additional Terms
If you obtained the App from the Apple App Store, the following additional terms apply. In the event of a conflict between these Terms and Apple's Licensed Application End User License Agreement (the “Apple EULA”) with respect to your use of the App, the Apple EULA controls only to the extent of that conflict.
- Parties. These Terms are between you and WordGate only, not Apple. Apple is not responsible for the App or its content.
- Scope of License. The license granted to you is limited to a non-transferable license to use the App on any Apple device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms.
- Maintenance and Support. WordGate is solely responsible for providing any maintenance and support, as required under applicable law. Apple has no obligation to provide any maintenance or support for the App.
- Warranty. WordGate is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- Product Claims. WordGate, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims under consumer-protection, privacy, or similar legislation.
- Intellectual Property. In the event of a third-party claim that the App or your use of it infringes intellectual property rights, WordGate (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal Compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Google Play — Additional Terms
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
