Terms of Service

These Terms of Service (“Terms”) govern your use of the WordGate mobile application (the “App”) operated by WordGate (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

WordGate is a language-learning application that helps you build vocabulary by integrating with your device's Screen Time (iOS) or overlay service (Android) to block selected apps until you complete daily vocabulary practice sessions. The App provides word introductions, grammar lessons, quizzes, typing exercises, sentence building, and recall tests.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.

4. Phone-Locking Functionality

By enabling the phone-locking feature, you acknowledge and agree that:

• WordGate will use your device's Screen Time API (iOS) or overlay/accessibility services (Android) to restrict access to apps you select.
• You are solely responsible for choosing which apps to block and configuring your daily schedule.
• WordGate provides 3 emergency bypasses per week for situations where you need immediate access to your phone.
• Essential functions such as phone calls, emergency services, and system settings remain accessible at all times.
• WordGate is not responsible for any inconvenience, missed notifications, or inability to access specific apps while your phone is locked.
• You can disable the phone-locking feature at any time through the App's settings or by removing the necessary device permissions.

5. Subscriptions and Payments

WordGate offers both free and premium subscription plans:

• Free plan: Access to core features with limitations on the number of languages, daily words, and other features as described in the App.
• Premium plan: Full access to all features, languages, and content for a recurring subscription fee.

Subscriptions are processed through Apple App Store or Google Play Store via RevenueCat. By subscribing, you agree to the following:

• Subscription fees are charged to your App Store or Play Store account at the beginning of each billing period.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's App Store or Play Store settings.
• Refunds are subject to the policies of Apple or Google, as applicable.

6. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent or disable the phone-locking mechanism through unauthorized means
• Interfere with or disrupt the App's servers or infrastructure
• Use automated systems or bots to interact with the App
• Share your account credentials with others

7. Intellectual Property

All content in the App — including but not limited to text, word definitions, grammar lessons, translations, example sentences, graphics, logos, icons, and software — is the property of WordGate or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any content without our express written permission.

8. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee any specific learning outcomes. Language proficiency depends on many factors including your individual effort, consistency, and use of the App alongside other learning methods.

9. Limitation of Liability

To the fullest extent permitted by law, WordGate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or any damages arising from your use of or inability to use the App.

In particular, we shall not be liable for any damages resulting from the phone-locking feature, including missed notifications, inability to access apps, or any disruption to your daily activities.

10. Indemnification

You agree to indemnify and hold harmless WordGate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's settings.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WordGate operates, without regard to conflict of law principles.
